Former Montgomery deputy acquitted in theft case A sheriff's deputy fired after the theft of items from a property room is cleared of the charge.

DAYTON | — A former Montgomery County sheriff's deputy was acquitted Wednesday of stealing items from the property room at the sheriff's office, according to documents filed with Montgomery County Common Pleas Court.
David Blackwell, indicted in September on a charge of theft in office, was found not guilty by Judge Jeffrey E. Froelich.
Sheriff Dave Vore put Blackwell, then 31, and Deputy Robert Dugan, then 58, on paid administrative leave Aug. 25 after an investigation into a property room theft led to the recovery of a computer game, a gun case and a bulletproof vest.
The items, except for the vest, had been earmarked for auction, Vore told reporters.
Blackwell, who had been with the sheriff's office eight years and a deputy for three, was fired in October.
Dugan, who had been with the sheriff's office 17 years, was also indicted in September on a charge of theft in office. He pleaded guilty to a lesser charge of theft. His sentencing is scheduled for May 24.
